A eficiência em direito penal

Resumo: No contexto atual, acabam fortalecidas as noções funcionalistas e utilitaristas de eficiência. Contudo, tais visões podem levar a uma instrumentalização sem precedentes do direito penal e da pessoa humana. Daí a relevância de se apreciar uma visão onto-antropológica, a partir do fundamento da relação de cuidado de perigo, da função de proteção de bens jurídicos e da finalidade que busca a justiça e a paz jurídica. Assim, se poderia construir uma noção mais robusta de eficiência, justamente pelo equilíbrio entre o fundamento, a função e a finalidade do direito penal. Isto é, quando o direito penal estiver a reconstruir ou manter uma relação de cuidado de perigo, proteger um bem jurídico e realizar a justiça e a paz, estaremos diante de um direito penal eficiente.

Abstract: In the current context, ultimately strengthened the functionalist and utilitarist notions of efficiency. However, such views may lead to an unprecedented instrumentalization of criminal law and the human person. Hier is the importance of onto-antrological notion, from the relationship of care, the function of protect the legal good interests and purpose that justice and peace. So we could build a more robust notion of efficiency, just fer balance between the foundation, the function and purpose of the criminal law. This is when the criminal law is to rebuild or maintain care, protect a legal good and attaining justice and peace, we will be facing criminal law im efficiently.
